What is Title?

Title is the legal right that a person has to the ownership and possession of land.

Why do I need to insure the Title to my property?

Even with the most diligent of title companies relying on public records and searching all known aspects of the title of real property, title defects can occur. Title insurance is a means of protecting yourself from financial loss associated with an unknown or undisclosed loss due to right of title ownership. There may be hidden defects that even the most careful title search would not reveal.

My lender requires me to purchase a Lender’s Title Insurance Policy, doesn’t that protect me, the homeowner, as well?

No. There are two types of title insurance. A Lender’s Policy insures that your lender has a valid lien on the property. Most lenders will require that the borrower purchase this type of coverage as a stipulation of receiving the loan. However, an Owner’s Title Insurance Policy is also available and protects the homeowner’s interest in the property. Defects in the title to the property would expose the homeowner to claims against the title to the property. If a valid claim is filed, your title insurer has a duty to defend you against any covered claims and would cover any financial losses up to the face value of the policy. You may think that a problem with your title is a remote possibility, but one out of every four title searches exposes an issue. Possible title issues include, but are not limited to, tax liens, forged signatures in the chain of title, recording errors, claims by missing heir and/or an ex-spouse. An Owner’s Title Insurance Policy will protect you against the potential loss of your most valuable material asset, your home.

Does Railway Title offer different types of Owner’s Title Insurance Policies?

Yes. We understand that there are a number of concerns for homeowners regarding the protection of the title to their property. We offer a Homeowner’s Policy of Title Insurance Policy and a Standard ALTA Owner’s Title Insurance Policy. The Homeowners Policy provides the homeowner with additional protections that are highly recommended if the property is intended to be the owner’s primary residence. The one-time premium for the available policies are directly related to the value of your home and is typically less expensive then your annual auto insurance policy. The one-time title insurance premium is paid when you purchase your home yet it continues to provide complete coverage for you as long as you or your heirs own the property.
